These Terms of Service (“Terms”) govern your access to and use of our website, secure clinical portal, and instruction triage services. By instructing us, registering an account, or accessing the portal, you (“Solicitor,” “Legal Practitioner,” or “User”) agree to be bound by these Terms.

1. Acceptance of Terms
By onboarding via our secure gateway, registering an account, uploading medical records, or submitting a case triage inquiry, you warrant that you are a qualified legal practitioner acting in a professional capacity and that you accept these Terms in full. If you do not agree to these Terms, you must not access the portal or submit instructions.
2. Scope of Service
Key Service Clause:
“Reports are drafted solely by accredited specialist panel experts of Clinical Expert Witness Chambers.”
We provide expert witness services specializing in Ear, Nose & Throat (ENT) Surgery, Paediatric & Adult Audiology, and General Practice clinical negligence audits. The Services include preliminary triage, desk merit reviews, and formal medicolegal reporting for the courts of the United Kingdom.
3. Case Instructions & Anonymization
You agree to submit instruction summaries and client briefs in strict compliance with our GDPR Guidelines. Strictly enter **claimant initials only** (no names) during the initial enquiry and onboarding phases. You must verify that any documentation uploaded contains necessary permissions or legal basis under UK GDPR Article 9(2)(f) for the establishment or defense of legal claims.
4. Secure Portal Access & Security
Access to our clinical data portal is strictly authenticated via single-use encrypted secure links and password authorization. You are responsible for safeguarding your access credentials and password. Any actions performed under your logged credentials will be deemed actions by you. You agree to notify us immediately of any unauthorized breach or credential compromise.
5. Payment Terms
Key Financial Clause:
“Invoices are raised upon draft finalization and are payable net 30 days prior to report release.”
Preliminary triage assessment fees (if applicable) are outlined during the intake process. For formal medicolegal reports, invoices are raised upon finalization of the draft report. Payment is due within 30 calendar days of invoice issuance. Final signed report documents will be released to the instructing firm only upon receipt of cleared funds in full.
6. Intellectual Property
All content on our website, trademarks, layout styles, databases, and portal scripts are the exclusive intellectual property of Clinical Expert Witness Chambers. We grant you a limited, non-exclusive, non-transferable license to access files uploaded relative to your instructions solely for the purpose of the litigation proceedings for which they were compiled.
7. Limitation of Liability
Our expert witness reports reflect the independent, professional opinion of the clinical specialist in accordance with civil procedure rules. We accept no liability for the outcome of legal claims. Our maximum liability under these terms is strictly limited to the fees paid by you to us under the specific instruction that gives rise to liability.
8. Governing Law & Jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes), shall be governed by and construed in accordance with the law of England and Wales. You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such disputes.
